Today I have an important announcement to make. Another Paul Barford living in Poland, who has made a so called funny blog on me, Ha Ha . Maybe not so funny now.
The pages of this site have all been filed for evidence, by Google and Carter Ruck. The problem has been providing enough evidence as to nail him. On the 2nd August I sent him an email which said.:
Dear Paul Barford
I am the proprietors of all copyright in a literary and artistic work from the web site ‘The Portable Antiquities Society‘. We have reserved all rights in the Work, which was first expressed in material form on the Portable Antiquities Society web site 2011.
It has come to our attention that items on your various blogs is identical/substantially similar to our copyrighted Work. Permission was neither asked nor granted to reproduce our Work and your Work therefore constitutes infringement of our rights. In terms of the Copyright Statutes, we are entitled to an injunction against your continued infringement, as well as to recover damages from you for the loss we have suffered as a result of your infringing conduct.
In the circumstances, we demand that you immediately:
1. remove all infringing content and notify us in writing that you have done so;
2. pay a licensing fee in the amount of £500 per photograph and text.
3. Immediately cease the use and distribution of copyrighted material;
4. Undertake in writing to desist from using any of our copyrighted Work in future without prior written authority from us.
We await to hear from you by no later than close of business on 3rd August 2011
This is written without prejudice to our rights, all of which are hereby expressly reserved.
Yours faithfully,
Steve Taylor
He had replied to this by placing acknowledgement on his blog in a mocking fashion, but he has understood that my reproduction fee was £500 per image. Since that time he has gone on to download another 80 images which were my copyright and these now have been logged by Google and Carter Ruck.
Accordingly the use of fair dealing cannot be used in this instant as it was used in a malicious and vindictive way and not just criticism. Several images were clearly not mine and were placed in such manner as to damage my reputation.
My blog which is clearly not in good taste, but is satire, where his has linked to my personal information making it clear about the bloggers intention to damage my reputation.
I will now make it clear, I am not in the business of bankrupting people but if the offending blog and all the other blogs about heritage issues written by this person are not removed by Sunday 11th September. I will instruct Carter Ruck to proceed in suing for copyright infringement which they have told me is £40,000 as there are 80 images @£500 each, plus damages and court cost which will take the figure to over £100,000.
I will sue using No Win No Fee and will take out insurance against losing the case.

The Judgement will be enforced in the law of the land that the debtor lives.

Under the Brussels Regulation and the Lugano Convention a creditor can enforce a debt in another country if that country uses the regulation or convention.
